Many buyers, especially those who had booked even before the existence of RERA are still awaiting possession.\u00a0<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Now concurrent role with the RERA is in place, both new and ongoing projects are to be brought within its fold. RERA authority of respective states needs to be more stringent with respect to following rules and Norms.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Objectives_of_RERA\"><\/span><b>Objectives of RERA<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The following are the main crucial objective that coincides with RERA implementation:-<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The most important sector for which RERA implemented\u00a0 is to Regulate and promote the Real Estate Sector<\/span><\/li>\n<li><span style=\"font-weight: 400;\">To effectively maintain the transparency and efficiency in the sale of Plot, Apartment or Building.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">To Protecting the Interest Of Consumers.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">To maintain and Adjudicating Mechanism for speedy trials. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">To establish Appellate Tribunal to hear all matters thereof.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"What_should_a_homebuyer_do\"><\/span><span style=\"font-weight: 400;\"><b>What should a homebuyer do?<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As a new buyer in the re-sale market, Buyer has to assure that the Promoter has received completion\/occupancy certificate. Project&#8217;s permanent registration number provided by the state&#8217;s Regulatory Authority also required to be Ask for it even before Buyers make a visit to the project site.\u00a0<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Basic_Understanding_of_RERA_Terminology\"><\/span><strong>Basic Understanding of RERA Terminology:<\/strong><b><br \/>\n<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are certain persons\/projects (namely, Promoter(who initiate the following activity as below mentioned), a real estate agent(the mediator) and (real estate project) for which registration under RERA is mandatory. Before proceed to the relevant\u00a0 process for registration of Promoter and Agent, first we need to understand the following terms:\u00a0<\/span><\/p>\n<ul>\n<li><b>Promoter;<\/b><\/li>\n<li><b>Real estate Agent;<\/b><\/li>\n<li><b>Real estate project.<\/b><b><br \/>\n<\/b><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"1_Promoter\"><\/span><b>1. Promoter<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">Who constructs building or apartments for selling purpose<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Who transform the existing building or apartments for selling purpose\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Who sell land (plots)\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00a0Any development authority [eg: DDA, HUDA, etc.]\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00a0Housing Board Co-operative society\u00a0<\/span><\/li>\n<li>The person who is the holder of power of attorney <span style=\"font-weight: 400;\">from owner to construct apartment or building or plot for sale<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Any other person who is engaged in selling of any building to the general public<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"2_Real_Estate_Agent\"><\/span><b>2. Real Estate Agent\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>\u00a0Real estate agent means any person who:\u00a0<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Act as a mediator between buyer &amp; seller for negotiation, either\u00a0 for sale or purchase of plot, apartment or building <\/span><\/li>\n<li>In consideration of his service, he Receives remuneration or commission or brokerage<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"3_Real_Estate_Project\"><\/span><b>3. Real Estate Project\u00a0\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">Real Estate Project means Making or constructing of building or apartment for selling purpose to the general public<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Converting the building (existing) for selling purpose <\/span><\/li>\n<li>Construction of land into the apartment for sale purpose<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"The_Below_mentioned_projects_should_be_covered_under_RERA_in_the_prescribed_application_in_Form-A\"><\/span><b>The Below mentioned projects should be covered under RERA in the prescribed application in Form-A.<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><b>On-Going Projects <\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Promoter has to make an application to the authority for registration within a period of 3 months of projects for ongoing projects exist on the date of commencement of the Act where the Completion Certificate has not been issued.\u00a0<\/span><\/p>\n<p><b>New Projects <\/b><span style=\"font-weight: 400;\">:\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Before booking, selling or offering for sale in such projects, the promoter has to register their project with the Authority. In case a project is to be made in phases, then each phase would be considered as a single project, and the promoter would have to obtain registration for each phase.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Promoter has to make an application to the authority for registration for all commercial or residential projects where land area exceeds by 500 Square Metres or Number of apartments exceeds by 8.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Terms_before_Selling_of_Real_Estate_Project\"><\/span><b>Terms before Selling of Real Estate Project<\/b><span style=\"font-weight: 400;\">:\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">No advertisement, marketing, booking, selling or an invitation for purchase of plot, apartment or building by the promoter in any planning area, without registering the <a href=\"https:\/\/aktassociates.com\/blog\/maha-rera-registration-projects-documents\/\">real estate project<\/a> with the Regulatory Authority;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">RERA act does not specify any\u00a0 registration of real estate project is required in the case area<\/span><\/li>\n<li><\/li>\n<li><span style=\"font-weight: 400;\"> of land does not exceed 500square meters or the number of apartments does not exceed eight inclusive of all phases;\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">If the registration completion certificate has already been issued under prior to RERA act, no registration is required in case of renovation or repair or re-development.<\/span><\/li>\n<li>A promoter shall not accept if the cost of the project exceeds sum more than 10%, as an advance payment or an application fee, from a customer without first entering into a written agreement.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Grant_of_Registration\"><\/span><b>Grant of Registration :\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">On receipt of application in Form A, the authority shall within 30 days grant or reject the Registration subject to the provisions of the Act and the rules and regulations made thereunder.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">if all the conditions are satisfied then the registration shall be granted to the promoter and a registration number, Login Id and password for accessing the website of the Authority shall also be provided, to create his web page. It is pertinent to mention here that no application shall be rejected by the Authority unless the applicant has been given an opportunity of being heard in the matter.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Deemed_Registration\"><\/span><b>Deemed Registration :\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If the application is neither accepted nor rejected by the Authority, within 30 days, then application shall deem to be registered.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><b><\/b><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Registration_Fees\"><\/span><b>Registration Fees\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>For making registration, payment has to be made for registering Under RERA\u00a0 by paying prescribed fees through any digital means.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Grounds_Of_Filing_A_Complaint_With_MahaRERA\"><\/span><b>Grounds Of Filing A Complaint With MahaRERA<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>Any aggrieved buyer can\u00a0file a complaint in MahaRERA\u00a0Authority or the Adjudicating Officer for the following issues faced at the hands of a builder:<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Delay in delivery of flat possession.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Refusal by the builder to refund the amount and cancel the booking.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Delay in registering the property under MahaRERA.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Extra or unwarranted demands by the builder.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Denial of penalty by the builder for delay in flat possession.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">When there is modification without the permission of the buyer in the project layout.<\/span><\/li>\n<\/ul>\n<h2><a href=\"https:\/\/aktassociates.com\/business-registrations\/maha-rera-registration\/maha-rera-new-projects-registration\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1509 aligncenter\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/08\/Get-register-MAHA-RERA-projects-Banner-image-29_08_2019-1.png\" alt=\"MAHA-RERA projects\" width=\"700\" height=\"150\" srcset=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/08\/Get-register-MAHA-RERA-projects-Banner-image-29_08_2019-1.png 700w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/08\/Get-register-MAHA-RERA-projects-Banner-image-29_08_2019-1-300x64.png 300w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/08\/Get-register-MAHA-RERA-projects-Banner-image-29_08_2019-1-20x4.png 20w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/h2>\n<h2><span class=\"ez-toc-section\" id=\"Refund_of_the_amount_in_case_of_delay_in_handing_over_of_possession\"><\/span><b>Refund of the amount in case of delay in handing over of possession<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>if the promoter is not able to hand over possession of the apartment, plot or building to the allottee\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">(i) As per the terms of the agreement of sale; or\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">(ii) Due to discontinuance of his business at the time of suspension of the project; or\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">(iii) Registration revocation or any other reason,\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">then the promoter would be liable, of the demand made by the allottee and to return the amount received from the customer with interest and compensation at the specified rate as provided under the Act.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, where an allottee does not want to withdraw the amount from the project then promoter shall be paid interest for every month of delay, till the Appartement is handed over to the customer.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Appeal_Procedure_In_MahaRERA_Tribunal\"><\/span><b>Appeal Procedure In MahaRERA Tribunal<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under the Maharashtra RERA Rules, 2017, an appeal can be filed with the help of a\u00a0<\/span>RERA lawyer in India<span style=\"font-weight: 400;\">\u00a0before the MahaRERA Appellate Tribunal against any order passed by the <a href=\"https:\/\/aktassociates.com\/blog\/maha-rera-quarterly-filing-and-updates\/\">MahaRERA<\/a> Authority\/Adjudicating Officer. An appeal can be filed with the MahaRERA Appellate Tribunal by any person aggrieved by the order or RERA Authority within 60 days from the date on which the order was received.
