as per the invoice value of the transactions <\/span><span style=\"font-weight: 400;\">as required to maintain as for complying the section 22 or 24, so they have an option to pay tax as a percentage of the turnover.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1640 aligncenter\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/09\/Robet-Half-2-1-1.png\" alt=\"Composition Scheme\" width=\"700\" height=\"400\" id=\"Registration_Liabilitysection_10\"><\/span><b>Registration Liability(section 10):<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As per section 10 of the CGST Act, 2017, A registered person whose <\/span><b>aggregate turnover**<\/b><span style=\"font-weight: 400;\"> in the <\/span><span style=\"font-weight: 400;\">Last <\/span><span style=\"font-weight: 400;\">\u00a0financial year is up to Rs. 150 lakhs <\/span><span style=\"font-weight: 400;\">(previously it was 100 lakhs),<\/span><span style=\"font-weight: 400;\">\u00a0has the option to pay tax under a composition scheme in which the taxpayer can pay the tax at the concessional rate.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Aggregate_Turnover\"><\/span><b>Aggregate Turnover:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">It shall include all kind of outward supplies like taxable supply, exempted supply, non-taxable supply or Zero rated supply.<\/span><\/p>\n<p><b>Note:<\/b> Exempted interest income shall not be considered while calculating the applicability of the composition scheme.<\/p>\n<p><span style=\"font-weight: 400;\"><strong>Note:<\/strong> if any person opted for composition Scheme, has received any supply which falls under RCM, then he shall be required to pay tax as applicable on such supply and not on the concessional rate under composition Scheme. In Simple words, the concessional rate is not applied in <a href=\"https:\/\/aktassociates.com\/blog\/reverse-charge-mechanism-rcm-gst\/\">RCM<\/a> Supplies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, for the following <\/span>Special\u00a0 Category States<b>,<\/b><span style=\"font-weight: 400;\"> the limit is of Rs. 75 lakhs:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Arunachal Pradesh<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Manipur<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Meghalaya<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Mizoram<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Nagaland<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sikkim<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tripura<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Uttrakhand<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Eligibility\"><\/span><b>Eligibility:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Note: Those registered persons who are engaged in the manufacturing of the following goods are not eligible to opt for composition scheme.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Ice cream<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Pan Masala<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tobacco\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">There are so many amendments has been incorporated in the composition scheme from 01.04.2019 which results in more benefits to the registered persons.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Supply_of_Service\"><\/span><b>Supply of Service:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Before the amendment, the registered persons engaged in supply of service (<\/span>Other than restaurant services)<span style=\"font-weight: 400;\"> are not eligible to opt for composition scheme. However, after the amendment, such persons are now eligible up to the higher of the following:<\/span><\/p>\n<p><b>10% of the turnover in that state\/UT in the previous financial year<\/b><\/p>\n<p><b>Or<\/b><\/p>\n<p><b>Rs. 5 Lakhs<\/b><\/p>\n<p><b>Note: <\/b><span style=\"font-weight: 400;\">these limit shall be applicable for the services other than restaurant services because for restaurant, the limit of Rs. 150 lakhs\/Rs. 75 Lakhs (as the case may be) shall be applicable.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Rates_of_GST_under_Compositions_Scheme\"><\/span><b>Rates of GST under Compositions Scheme :<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The rates under composition scheme have been bifurcated in 3 categories, which are as follows:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><b>Eligible Registered Persons<\/b><\/td>\n<td><b>IGST Rate<\/b><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Manufacturer<\/span><\/td>\n<td><span style=\"font-weight: 400;\">1%*<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Restaurant Service Provider<\/span><\/td>\n<td><span style=\"font-weight: 400;\">5%*<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Any other supplier\u00a0<\/span><\/td>\n<td><span style=\"font-weight: 400;\">1%**<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"font-weight: 400;\">The tax liability shall be calculated on <\/span>the taxable supply of goods or services <span style=\"font-weight: 400;\">and not on the turnover. We checked turnover only to calculate the applicability of the composition scheme.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, For any other suppliers, a rate of 1% shall be calculated on the<\/span> Turnover in the State<b>, <\/b><span style=\"font-weight: 400;\">not on the Taxable Supplies.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"InvoicesBill_Of_Supply\"><\/span><b>Invoices(Bill Of Supply):<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">A composition dealer is not eligible to charge tax on his outward supplies and since he cannot levy a tax on his invoice hence he cannot issue a Tax invoice. Instead, he shall issue \u201c<\/span><span style=\"font-weight: 400;\">Bill of Supply\u201d<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Input_Tax_CreditITC_Claiming\"><\/span><b>Input Tax Credit(ITC) Claiming:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Also, the registered person opt for the composition scheme shall not be able to claim<a href=\"https:\/\/aktassociates.com\/blog\/input-tax-credit-itc\/\"> ITC in GST<\/a> because he is<\/span> already paying the deposit at a concessional rate<span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Tax_Deposit_under_Composition_Scheme\"><\/span><b>Tax Deposit under Composition Scheme:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Composition dealer has to deposit a tax on a quarterly basis within 18<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> of next month.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A composition dealer has to file a quarterly return within 18<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> of the next month from the end of the relevant quarter in form GSTR-4 in which he shall enter all the information related to inward supplies, tax payable and tax paid. The person shall be compulsorily required to file this return even as nil return.\u00a0<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Revised_Return\"><\/span><b>Revised Return:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If after the filing of the return, dealer notices any error or omission then it has the option to rectify such incorrect particulars in the subsequent returns up to the earlier of the following:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Due date of filing of 2<\/span><span style=\"font-weight: 400;\">nd<\/span><span style=\"font-weight: 400;\"> quarter return of Next year<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Or\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Date of furnishing the relevant<\/span> <a href=\"https:\/\/aktassociates.com\/blog\/gstr-9-everything-you-want-to-know-about-gst-annual-return\/\">Annual Return in form GSTR-9A<\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Recent_Notification_by_Government\"><\/span><b>Recent Notification by Government:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Further, as per notification no.2\/2019 issued on 07.03.2019, the government has given one more benefit for the small taxpayers. Those persons whose aggregate turnover is up to Rs. 50 lakhs but still they were not eligible for composition scheme, they have an option to pay central tax @ 3% each for CGST and SGST in intrastate supply and 6% for IGST in interstate supply.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this scheme, only the name has changed from composition scheme to Central tax otherwise the other conditions are same i.e. depositing of tax or filing of the return, etc.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ineligibility\"><\/span><b>Ineligibility:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Following are the categories of persons who are not eligible to opt for composition scheme:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A person making inter-state supply of goods. [eg. one state to another, the export of goods]<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Supplier of any service other than Restaurant services and Limited value services along with the main business. [Maximum value: 10 % of turnover within the state\/UT or 5,00,000 whichever is higher ] ie if the value of these services exceeds the maximum limit then the person not eligible for the scheme.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Supplier of non-taxable goods<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The person who supply goods through E-commerce operator.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Manufacturer of specified goods. [Pan masala, tobacco, ice cream]<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Casual taxable person and NR.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"><strong>Note:<\/strong> As we already discussed above, but it is very important to note that Interest received on extending deposit loan and advances shall be ignored completely.<\/span><\/p>\n<p><b>Example :\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s understand the eligibility of composition scheme with an example for better understanding:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><b>Supplies<\/b><\/td>\n<td><b>Turnover<\/b><\/td>\n<td><b>To be taken for Comp.
