To fulfill the dream the people takes home loans (housing loans).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Housing Loan Involves both Principal &amp; Interest Component, Government of India has provided certain Exemptions &amp; Deductions for both the Principal repayment &amp; Interest Expenditure Incurred under various provisions of the <a href=\"https:\/\/aktassociates.com\/blog\/income-tax-rules-for-nri\/\">Income Tax Act<\/a>,1961.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Below_we_will_discuss_Deductions_in_respect_of_Housing_Loan\"><\/span><strong>Below we will discuss Deductions in respect of Housing Loan\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 24(b)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 80C<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 80EE<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 80EEA<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Section_-24_b\"><\/span><b>Section -24 (b)<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Section-24(b) of Income Tax act, 1961, provides deduction in respect of the Interest on Home loans taken for the purpose of the purchase, construction, repair, renewal or reconstruction of the property, under the Head Income from House Property\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Interest can be classified as post-construction period &amp; Pre Construction period Interest.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Post-_Construction_Period_Interest\"><\/span><strong>Post- Construction Period Interest<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Let out property<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In Case of Housing Loan acquired for the purpose of the purchase, construction, repair, renewal or reconstruction of the Let out property, the assessee can claim a deduction in respect of that Interest expenditure incurred for that period without any quantum of the limit under section 24(b) of Income Tax Act,1961.<\/span><\/p>\n<p><strong>Self Occupied property<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In Case of Housing Loan acquired for the purpose of purchase, construction, repair, renewal or reconstruction of the Self Occupied property, the assessee can claim deduction in respect of that Interest expenditure incurred for that period not exceeding Rs.30,000\/- or Rs.2,00,000\/- (as the case may be) limit under section 24(b) of Income Tax Act,1961.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Deduction For Self Occupied Property will be Rs.2,00,000\/- under sec-24(b) in respect of interest on the loan is taken, if it satisfies below conditions<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Housing Loan borrowed on or after 1.04.1999<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Housing loan should be borrowed for the purpose of acquisition or construction (i.e., not for repair, renewal, reconstruction).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Acquisition or construction should be completed within 5 years from the end of the financial year in which the loan has been borrowed.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The lender of the loan should certify that such interest is payable in respect of the amount advanced for acquisition or construction of the house or as re-finance of the principal amount outstanding under an earlier loan taken for acquisition or construction of the property.<\/span><\/li>\n<\/ul>\n<p><strong>Recent amendment<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">w.e.f. A.Y.2020-21, Interest on Housing loan can be allowed as a deduction in respect of 2 self-occupied properties.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Note:<\/strong> The overall limit should not exceed Rs.30,000\/- or Rs.2,00,000\/- as the case may be.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Pre-_Construction_Period_Interest\"><\/span><strong>Pre- Construction Period Interest<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Pre-construction period interest is the interest incurred between\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The date of borrowing loan\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">and\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The date of repayment of loan\/31<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> march immediately prior to the date of completion of the construction\/acquisition of the property (whichever is earlier)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Pre-Construction period Interest is allowed as a deduction in 5 equal installments starting from the year in which property has been constructed or Acquired.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"_Section_80C-Deduction_irf_Certain_Payments\"><\/span><span style=\"font-weight: 400;\">\u00a0<\/span><b>Section 80C-Deduction i.r.f Certain Payments<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">As per section 80C(XVII), the principal repayment for the housing loan borrowed &amp; stamp duty, registration fee and other expenses incurred for the purpose of transfer of such house property can be claimed as a deduction.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Overall Limit for claiming deduction should not exceed Rs.1,50,000\/-<\/span><\/p>\n<h3><a href=\"https:\/\/aktassociates.com\/nri-lower-tds-certificate-sale-of-property-in-india\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2892\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/11\/unnamed-3.png\" alt=\"TDS Certificate\" width=\"700\" height=\"150\" srcset=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/11\/unnamed-3.png 700w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/11\/unnamed-3-300x64.png 300w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2019\/11\/unnamed-3-20x4.png 20w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/h3>\n<h3><span class=\"ez-toc-section\" id=\"Section_80EE\"><\/span><b>Section 80EE<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">As per sec-80EE of Income Tax act,1961, there shall be allowed a deduction of up to Rs.50,000\/-\u00a0 in respect of the Interest incurred on loan taken for the purpose of acquisition of house property if the following conditions have been satisfied<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Applicable to the only Individual<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Loan sanctioned should not exceed 35 Lakhs<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The value of residential property acquired should not exceed 50 Lakhs<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It should be the First House property for the assessee<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The loan should be sanctioned during the period 01\/04\/2016 to 31\/03\/2017.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Section_80EEA\"><\/span><b>Section 80EEA<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">w.e.f. 01\/04\/2020 a new section 80EEA (Deduction on certain housing loan interest) shall be inserted by the Income-tax cat,1961.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As per sec-80EEA of Income Tax act,1961, there shall be allowed a deduction of up to Rs.1,50,000\/-\u00a0 in respect of the Interest incurred on loan taken for the purpose of acquisition of <a href=\"https:\/\/aktassociates.com\/blog\/tds-on-sale-of-property\/\">residential house property<\/a>, if the following conditions have been satisfied<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Applicable only to Individuals<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The value of residential property acquired should not exceed 45 Lakhs<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It should be the First House property for the assessee<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight:
