It is dealt under The\u00a0Copyright\u00a0Act, 1957.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Copyright_Registration_Process_in_India\"><\/span><b>Copyright Registration Process in India:-<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_registration\" target=\"_blank\" rel=\"noopener noreferrer\">Registration of copyright<\/a>\u00a0is optional, and not mandatory. It is not a prerequisite condition for claiming the copyright.<\/span><\/p>\n<p><b>The procedure for registration is as follows:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Registration application has to be made on as prescribed in the first schedule to the Rules;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Different applications should be applied for registration of each work;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Each application along with\u00a0 the requisite fee should be given on prescribed format in the second schedule to the Rules; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The format of applications should be duly signed by the person who has applied or the advocate in whose favor a Vakalatnama or Power of Attorney has been executed. The<a href=\"https:\/\/aktassociates.com\/blog\/power-of-attorney\/\" target=\"_blank\" rel=\"noopener noreferrer\"> Power of Attorney<\/a> signed by the party and acknowledged by the advocate should also be attached along with.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Document_required_for_registration_Process\"><\/span><b>Document required for registration Process:<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Documents which are required to be submitted either by Hand or By Post along with application form.<\/span><span style=\"font-weight: 400;\"> According to the work, everyone has to submit the different documents which are<\/span><\/p>\n<p><strong>Artistic:- The documents which are supposed to be submitted\u00a0 are as mentioned below:<\/strong><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">2 set of Copies of work (His original creativity)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Amount of DD \/IPO according to the job and amount per work<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">NOC is required from the artistic if the applicant is different from Artistic or copyright holders or copy of the agreement.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">NOC from publisher or author as the case may be\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Person\u2019s\u00a0 NOC whose photograph appears on the work.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If the application for the copyright is being filed by anyways from the attorney, a specific Power of Attorney in original duly signed by the applicant and that must be accepted by the attorney.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Work_needs_to_be_original\"><\/span><b>Work needs to be original:-<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">To get\u00a0copyright registered\u00a0it is important that the work is original because the original literary work is the result of the human mind and his efforts it may consist of a many of verbal\/oral or numerical statements and it\u2019s not necessary that it should have that artistic blend always.
