For example: As we know that for resident Indians the global income shall become taxable in India. However, if the resident Indian earned income in the US which becomes taxable there and also taxable in India, in that case, such assessee had to bear the weight of 2 taxes on the single income. Similarly, if any non-resident has earned income in India which becomes taxable in India as well as in its residence country then also, he would have to pay tax in 2 countries on the single income. This is where the government has introduced the <a href=\"https:\/\/aktassociates.com\/blog\/double-taxation-by-nri\/\">Double taxation avoidance agreement (DTAA)<\/a>. We will understand this in question-answer form.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-3839 aligncenter\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/DTAA-1.jpg\" alt=\"DTAA \" width=\"700\" height=\"400\" srcset=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/DTAA-1.jpg 700w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/DTAA-1-300x171.jpg 300w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/p>\n<p><b>Ques: How does DTAA prevent the hardship as explained above and avoid double taxation on the same income?<\/b><\/p>\n<p><b>Sol: <\/b><span style=\"font-weight: 400;\">Government will provide relief to the assessee in the following manner:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\">Bilateral relief: Countries with whom India is having an agreement, will adopt this method. Under this method, the following options have been given to the assessee which is as follows:<\/span><\/li>\n<\/ol>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exemption Method: Under these options, the assessee will have to pay tax only in one country and the agreement will prescribe this thing that whether the person would have to pay tax in his residence country or the other one. In other words, the income of the assessee shall be taxable only in one country.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As per these options, income shall be taxable in both countries however the country in which such assessee is having the residency, will allow the exemption at the time of filing of his return.\u00a0<\/span><\/li>\n<\/ul>\n<p><b>Ques: Whether it is mandatory for the person to comply with DTAA even if its results in a disadvantage for him?<\/b><\/p>\n<p><b>Sol:<\/b><span style=\"font-weight: 400;\"> No, It is to be noted that the provisions of DTAA shall be applicable only when it becomes beneficial to the assessee. For Example: <\/span><span style=\"font-weight: 400;\">if as per tax laws with a foreign country, the royalty is to be taxed @35% then it will be beneficial for the assessee to apply Indian <a href=\"https:\/\/aktassociates.com\/blog\/latest-provisions-under-income-tax-and-gst\/\">income tax<\/a> law as Section 115A of the income tax act where the royalty rate is 10% is more beneficial to the assessee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Similarly, If a Non-resident receives any dividend from an Indian company and as per DTAA, such dividend is taxable @ 10% in India, then DTAA shall not apply but <\/span><span style=\"font-weight: 400;\">section 10(34) of income tax shall apply. which provides that the dividend is exempt from tax in India.<\/span><\/p>\n<p><a href=\"https:\/\/aktassociates.com\/nri-lower-tds-certificate-sale-of-property-in-india\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3571 size-full\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2020\/02\/Are-you-planning-to-sell-your-property-as-an-NRI_.png\" alt=\"Are you planning to sell your property as an NRI_\" width=\"700\" height=\"150\" srcset=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2020\/02\/Are-you-planning-to-sell-your-property-as-an-NRI_.png 700w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2020\/02\/Are-you-planning-to-sell-your-property-as-an-NRI_-300x64.png 300w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2020\/02\/Are-you-planning-to-sell-your-property-as-an-NRI_-20x4.png 20w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p><b>Ques: Whether the tax rate as mentioned in DTAA is further increased by cess and surcharge?<\/b><\/p>\n<p><b>Sol: <\/b><span style=\"font-weight: 400;\">No,<\/span> <span style=\"font-weight: 400;\">If the rate of DTAA is to be applied on assessee then the same shall not be increased by surcharge or any cess.<\/span><\/p>\n<p><b>Ques: Whether the assessee has to pay double tax on the same income if the other country does not have DTAA with India?<\/b><\/p>\n<p><b>Sol:<\/b><span style=\"font-weight: 400;\"> If the assessee has earned any income outside India in the financial year in which he was the resident of India, <\/span><span style=\"font-weight: 400;\">In that case, he shall be eligible to claim the deduction from the Indian income-tax payable. However, to claim the deduction, he has to satisfy a few conditions which are as follows:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The assessee should be a resident of India in the previous year in which the income becomes taxation in a country other than India.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The income should not be accrued or arise in India.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The income in question should be taxable in the foreign country.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The assessee has already paid the tax on such income in the foreign country.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There should not be any agreement exists between India and the foreign country in which the income becomes taxable.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If all the above conditions are satisfied then the assessee shall be eligible for the deduction of lower of the following amount:<\/span><\/p>\n<ul>\n<li><b>Tax on such doubly taxed income at the rates applicable in India which shall be computed as under:<\/b><\/li>\n<\/ul>\n<p>Tax on the Total Income in India x Such double-taxed Income\/<span style=\"font-weight: 400;\">Total Income in India<\/span><\/p>\n<ul>\n<li><b>Tax on such doubly taxed income at the rates applicable in a foreign country which shall be computed as under:<\/b><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=59JmFYnqQ7Y&amp;t=22s\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3863 size-full\" src=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/Untitled-design-8.jpg\" alt=\"buying property\" width=\"1280\" height=\"720\" srcset=\"https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/Untitled-design-8.jpg 1280w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/Untitled-design-8-300x169.jpg 300w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/Untitled-design-8-768x432.jpg 768w, https:\/\/aktassociates.com\/blog\/wp-content\/uploads\/2021\/11\/Untitled-design-8-1024x576.jpg 1024w\" sizes=\"(max-width: 1280px) 100vw, 1280px\" \/><\/a><\/p>\n<p>Tax paid in Foreign Country x Such double-taxed income\/Total Income assessee in Foreign Country<\/p>\n<p><span style=\"font-weight: 400;\">This can be easily understood with the help of a simple example:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ex.: <\/span><span style=\"font-weight: 400;\">Mr.<\/span> <span style=\"font-weight: 400;\">A resident of India receives a royalty on books from a foreign country amounting to Rs.10,00,000 during the year ended 31.3.2020.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A foreign company has deducted the TDS of Rs.50,000 and sent the remaining amount of Rs.9,50,000 on 30.4.2020.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">India does not have a <a href=\"https:\/\/aktassociates.com\/blog\/double-taxation-by-nri\/\">double taxation<\/a> avoidance agreement with the government of the foreign country from which royalty is received.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The expenses incurred by Mr. A on earning the royalty are Rs.2, 10,000. His income from other sources<\/span><\/p>\n<p><span style=\"font-weight: 400;\">is Rs.50,000. The relief shall be calculated as follows:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">42,120\/ 6,40,000 <\/span><span style=\"font-weight: 400;\">X <\/span><span style=\"font-weight: 400;\">4,90,000 <\/span><span style=\"font-weight: 400;\">= <\/span><span style=\"font-weight: 400;\">32,248<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">50,000\/ 10,00,000 x 4,90,000 <\/span><span style=\"font-weight: 400;\">= <\/span><span style=\"font-weight: 400;\">24,500<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Hence, the relief shall be Rs.24,500 and hence the net tax payable shall be Rs.17,620.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This concept will be helpful not only to non-residents but also to the Indian residents as for the Indian residents the global income is taxable in India.
