RERA is the first regulator in the real estate market of India.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Home buyers have always felt burnt and have suffered as compared to sellers; it has been long due complaints to which the Government took a step in 2016, and the RERA Act became effective since 2017. Through RERA the Government has tried to introduce an impartial and reasonable contract between the seller and the buyer of the home. It aims at increasing the transparency in dealings and making it simpler for all the parties involved.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">RERA aims to protect those buyers who have not received the occupancy certificate. It has been observed that buyers suffer heavy losses while the project is in the construction phase. towards the allottees and to protect the latter\u2019s interest;<\/li>\n<li>Impart transparency, confirm just and fair contracts<\/li>\n<li>Minimize frauds and delays<\/li>\n<li>Introduce professionalism in the real estate market and to standardize the market.<\/li>\n<li>Clear and lucid communication between the promoter and the buyer<\/li>\n<li>Making both the developer and the buyers more responsible<\/li>\n<li>Start a regulatory vigilance mechanism to impose contracts.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Impact_of_RERA_on_Buyers_and_Sellers\"><\/span>Impact of class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Due to the absence of a proper regulator in the real estate market, this market was utterly uncontrolled. But, this introduction of this act a regulator has been introduced in each state and the union territory. It is a robust body to address the grievances of the stakeholders.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Registration_under_the_Act_is_Compulsory\"><\/span>Registration under the Act is Compulsory<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>As per the central act, real estate project which covers the total area of 500 sq meters or more or has 8 or more apartments, (it also includes their plans), is compelled to register with its individual state\u2019s RERA. An existing project which has not yet issued the OC also falls under the Act.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Promoters_are_required_to_state_every_minute_details_while_applying_for_registration_under_RERA_Some_of_them_are\"><\/span>Promoters are required to state every minute details while applying for registration under RERA. Some of them are:<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>Status of the land.<\/li>\n<li>Promoter&#8217;s detailed information.<\/li>\n<li>Approvals received.<\/li>\n<li>Plan of completion.<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"Specified_account_for_each_project\"><\/span>Specified account for each project:<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>One of the standard practices of promoters was that they used to invest one project\u2019s money in another and this was also the primary cause of the delay. To restrict that <a href=\"https:\/\/aktassociates.com\/blog\/maha-rera-registration-projects-documents\/\" target=\"_blank\" rel=\"noopener noreferrer\">RERA<\/a> states that promoters are required to have separate accounts for each project and they will have to park 70% of receivables from that project into the respective account. These are escrow accounts, and funds from the accounts can be used only for property and construction expenditures with permission of the escrow account manager or a certified professional.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Fair_disclosure_of_progress_by_promoters\"><\/span>Fair disclosure of progress by promoters:<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Promoters have to disclose the project\u2019s progress periodically, on the central website of RERA. Home buyers can easily log on to the page and check.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Fair_sale_agreement\"><\/span>Fair sale agreement:<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Promoters often used cannot include any a clause claiming penalty from buyers in case of failure to pay, but the contract never stated any such penalty for the promoters. Application of RERA has made such clauses considering stories of the past.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Key_Points_to_remember_when_registering_for_RERA\"><\/span>Key Points to remember when registering for RERA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Obligatory registration of all projects.<br \/>\nDistinct registration of each phase of the project.<br \/>\nA clear timeline regarding the projects\u2019 completion date.<br \/>\nExtension of project date can be only up to one year that too if the delay is not due to the promoter.<br \/>\nRegularly update the RERA website on projects status.<br \/>\nAudit of accounts to be done by a CA, every year once.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Documents_to_be_submitted_while_registering\"><\/span>Documents to be submitted while registering:<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>The genuine copy of all approvals.<\/li>\n<li>Commencement certificate.<\/li>\n<li>The sanctioned plan of the property.<\/li>\n<li>The layout of the plan.<\/li>\n<li>Project\u2019s specification<\/li>\n<li>Proposal for the project\u2019s development and completion.<\/li>\n<li>Planned amenities,<\/li>\n<li>Draft of allotment letter,<\/li>\n<li>Sale Deed<\/li>\n<li>Conveyance agreement.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Recent_Updates_regarding_RERA\"><\/span>Recent Updates regarding RERA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Post-registration of their respective projects under RERA, all of the promoters need to update the complete information on the Authority\u2019s website regarding the complete catalog of the types and number of plots\/apartments, all kinds of approvals taken for the project, No Objection Certificates (NOC) if applicable, the status of construction\/development backed with photos as their evidence, pending litigations (if any) and its status as per the Section 11 of the RERA Act.<\/p>\n<p>Promoters should also keep on filing the updates related to quarterly certificates stating the progress of the project, which is received from professionals such as Architects, Engineers, CA\u2019s. Such updates will be helpful for allottees to understand the status of the project from time to time. This will also help the prospective buyers to understand the movement of the apartments\/plots per quarter so that they are fully aware of the scenario before investing in the project. This will also enable the authority to know the development of the project from time to time.<\/p>\n<p>Such filings have to be done by the promoters till the project is completed and they need to submit the Occupancy Certificate post the completion of the project.<br \/>\nOne thing to note is that quarterly filings are now mandatory as per the act and rule, failure to which will attract penalties and fines as per Section 60 of the RERA act.
